I. SECOND INFORMATION LAYER – COOKIES POLICY

 

The user is informed that this Site uses cookies and/or similar technologies (hereinafter, “cookies”), which serve for the storage and recovery of data on terminal equipment (for example, a computer, a mobile phone or tablet) of the user when browsing. The term “Site” refers to any website, sections of a website, computer application (App), platform or similar, owned by the Banco Santander, S.A (hereinafter, the “Bank”) on which it provides an information society service. 

 

Cookies are files that are stored on the device of the user who browses via the internet or other types of platforms and applications (for example, smartphones and tablets) and that, in particular, contains a number that makes it possible to uniquely identify the user's device, even if it changes location or IP address.

We may also use similar technologies that serve for the storage and recovery of data such as local shared objects or flash cookies[1], web beacons, bugs or pixels [2], as well as any digital fingerprinting techniques of the device.

The specific uses we make of these technologies are described below.

 

[1] Local shared objects or flash cookies: these are a type of cookies that can store much more information than traditional cookies. Since they are independent from the browser used, they are more difficult to locate, view or delete and can be used, for example, to regenerate standard cookies.

 

[2]  Web beacons or bugs (sometimes called pixels): they are images that are imperceptible due to their size and colour, which are downloaded when visiting a website but that are stored in a second site and that allow the owner of that second site to record the visit of the user using the information that the browser of the latter provides when downloading the image (IP address, operating system, browser version, etc.).

This Site only uses technical cookies.

Technical cookies are those that allow the user to navigate through the Site and use the different options or services that exist on it, including those that are used to allow the management and operation of the Site and enable its functions and services. These cookies will be used, for example, to control traffic and data communication, identify the session, access restricted access parts, remember the elements that make up an order, perform the purchase process of an order, manage payment, control fraud linked to the security of the service, make the request for registration or participation in an event, count visits for the purposes of billing licences of the software with which the Site functions, use security elements during navigation, store content for the dissemination of videos or sound, enable dynamic content (for example, text or image loading animation) or share content through social media.

Due to their technical nature and as long as they are not used for other non-exempt purposes, cookies that allow the management, in the most efficient way possible, of the advertising spaces that, as another element of design or “layout” of the service offered to the user, have been included on the Site, application or platform based on criteria such as the published content, without collecting information of the users for different purposes, such as personalising that advertising content or other content, also belong to this category.

Additionally, cookies that help remember information for the user to access the service (of preference) are also considered technical cookies, when they have been chosen or configured by the service (for example, if you select the language of a website by clicking on the flag icon of the corresponding country), and only for this purpose.

What do we process the data for?

In certain circumstances, the use of cookies involves the processing of personal data of users who visit the Site, when they identify or provide certain identifying or contact data that make it possible to distinguish the browsing of some users from others or when the user is identified through an IP address.

How do we obtain your data?

·       Directly from you, through the information you provide us when you browse through our websites and mobile phone applications, through the use of cookies or any other type of online identifier or through the digital fingerprint of your device or terminal.

To whom will we communicate the data?

We communicate your personal data to:

·       Service providers of the Bank: The Bank has the collaboration of some third-party service providers who have access the users' personal data and who process the aforementioned data, as data processors, on behalf of the Bank as part of their services.

The Bank follows strict criteria for selecting service providers to comply with its data protection obligations and undertakes to sign with them the corresponding data processing agreement under which it will impose on them, among others, the following obligations: apply appropriate technical and organisational measures; process personal data for the agreed purposes and only in accordance with the documented instructions of the Bank; and to delete or return the data to the Bank once the provision of the services is complete.

Will data be transferred to third countries?

The Bank will only transfer the data to third countries if there is an adequacy decision that determines that it is a country with a level of protection comparable to that of the European Union, or failing that, applying adequate guarantees in accordance with data protection regulations, such as signing Standard Contractual Clauses or Binding Corporate Rules. The data subject may request additional information on those adequate guarantees through the means of contact indicated in the What are the users' rights? section.

How long will we store the data?

The personal data collected will be stored for the duration of the contractual relationship with the user or for as long as they are necessary for the purpose for which they were collected, all in accordance with the “How long will we store your data?” section of the privacy policy.

What are the users' rights?

The user may exercise their rights of access, rectification, objection, restriction, portability and erasure at the Bank or query any issue regarding the processing of their personal data by sending an email to privacidad@gruposantander.es or a letter to the following address: C/ Juan Ignacio Luca de Tena, 11-13, 28027, Madrid (A/A. Data Protection Officer/Privacy Office).
