GENERAL TERMS AND CONDITIONS OF USE OF THE "SANTANDER WORK CAFÉ PLATFORM"

Accessing and browsing this website implies acceptance of the terms and conditions of use and operation set out below. Both customers and non-customers of Banco Santander S.A. (hereinafter, the “user/users”) can browse the website and registration by the user is necessary to access the private URLs of the website, which we jointly call Work Café Platform (hereinafter, the “Platform”).

 

What is the "Santander Work Café Platform"?

The Platform has been exclusively developed and is owned by Banco Santander, S.A. (hereinafter, the “Bank”), an entity registered with the Bank of Spain under registration number 0049, with registered office in Santander, Paseo de Pereda, 9-12, and tax identification number A-39000013, to allow those who want to enjoy certain services and advantages (hereinafter, the "services") offered by Banco Santander, S.A. through its network of bank branches called Work Café (hereinafter, "Work Café") to do so by accepting the terms and conditions of use beforehand.

The Work Café is a specific physical space of Banco Santander that, under the Work Café brand, integrates one or more of the following services; bank branch, co-working space, holding of events and speciality cafeteria. In the co-working space offers spaces to work and spaces to hold meetings, internet connection and the opportunity to hold meetings and attend events.

There are two types of Work Café: Urban and University, the latter being smaller physical spaces, and so the services offered are less than in the Urban sites.

 

How do I register as a user on the Platform?

Natural persons over the age of 18 years, whether customers or not, may register as a user on the Platform, as may legal persons who have accepted the terms and conditions of use of this Platform.

Access process for users who are customers of Banco Santander:

1.       Access the workcafe.es site.

2.       Registration request in the "Access" tab.              

3.       Customer selects the “I am a customer” option, where a contact email must be provided that must be confirmed with an OTP. 

5.       The customer is provisionally registered as a customer user and can access all the features of the website.

When you go to the branch for the first time to make use of the rooms, co-working or events, you will be asked for your identification to verify that you are indeed a customer of Santander bank and permanently confirm your registration.

Access process for users who are not Banco Santander customers:

 

1.        Access the workcafe.es site.

2.        Registration request in the “Access” tab.

3.        User selects the “I am not a customer” option, where a contact email must be provided that must be confirmed with an OTP. 

5.       Acceptance of privacy policy.

6.        The user is registered as a non-customer user and can access all the features of the website.

The non-customer user must repeat this process every 6 months.     

 

What services does the Platform offer?

Through the “Platform” it will be possible to:

Obtain a unique and permanent user code that will allow you to access the services offered by the Work Café branches:

Make use of shared co-working stations whenever there is availability.

Book and access private co-working rooms (maximum 2 hours a week for customers and 1 hour for non-customers) as well as cancel bookings made.

Book a place to attend the events held at the Work Café, as well as cancel the booking made.

Search, through different filters in a search engine, the events that will take place in the future at Work Café.

Cancel registration as a user of the Platform.

 

What is a "Co-working" space?

The coworking space of the Work Café office is the area where its users can work at shared desks. No prior reservation is required but registration on arrival. Its use is limited to 5 hours per day per user unless there is a high demand, in which case it will be the office managers who will be in charge of determining the maximum time of stay of a user. 

 

What is a "Private Room"?

It is the Work Café office space that forms a closed room designed for users to hold private meetings either by inviting third parties or via remote connection. 

Its use requires prior booking by the user through the Platform and is limited to 2 hours per week for Banco Santander customer users and 1 hour for non-customer users. 

Booking of private rooms

Through the Platform, the user can search all the Work Café branches that have private meeting rooms available, book them, view which ones they have already booked and cancel their bookings. 

Booking events

Through the Platform the user can access a search engine showing the events that will take place in the future at the Work Café and book a place to attend, view those that they have already signed up for and cancel their bookings.

Responsibility of the User

For example, and without limitation, it is the responsibility of the User:

To use the information and content provided on the Platform in accordance with current legislation, the principles of good faith and generally accepted uses, and not to breach public policy or the provisions of these terms and conditions with their actions through the Platform. In this sense, Users undertake to make a lawful, diligent, honest and proper use of any information and/or content to which they have access through the Platform.

Therefore, the following is expressly prohibited:

 

Any use for unlawful purposes or purposes that jeopardise or prevent, may damage and/or overload, in any way, the use and normal operation of the Platform, or that directly or indirectly threatens it or any third party.

The use of the Platform for fraudulent purposes or purposes related to criminal offenses or unlawful activities of any kind.

The introduction or spreading of computer viruses that may cause unauthorised alterations of the content or systems that comprise the Website.

The sending or other distribution of content that may violate any applicable law or infringe any right of any party.

The Bank reserves the right to deny any attempt to access the Platform in cases where there is improper use thereof, or when any of the stipulations established in these terms and conditions or of the specific provisions applicable to them are breached.

 

The User will be solely responsible for the use of the Platform and for compliance with these terms and conditions in their entirety. Any violation of these terms and conditions may result in out-of-court or civil or criminal legal proceedings against the User, who will hold Banco Santander and Santander Group companies harmless in view of any monetary claims, court claims or loss that the User may suffer as a result of such infringement.

 

Banco Santander responsibility and warranty

The Bank has obtained the information and materials included on the Platform from sources considered reliable; however, although reasonable measures have been taken to ensure that the information is correct, the Bank does not warrant that it is accurate, complete or up to date and, consequently, it should not be trusted as if it were. Santander Group expressly declines any liability for error or omission in the Information contained on the pages of this Platform.

“Banco Santander” reserves the right to modify, suspend, cancel or restrict the content of the Platform and the links or information obtained through it, without prior notice.

It is forbidden to transmit or send through the Platform any illegal or unlawful content or messages that, in general, affect or violate the rights of the Bank or third parties.

On some occasions, this Website uses its own and third-party cookies to improve our services by analysing your browsing habits.

Cookies are filing systems that are stored on the computer of the User who browses via the internet and that, in particular, contains a number that makes it possible to uniquely identify the User's computer, even if it changes location or IP address.

 

The Website is accessible without the need for cookies to be activated, although their deactivation may prevent it from functioning properly.

The user’s personal data will be processed by the Bank as the data controller in accordance with the basic information on data protection that the user must accept at the time of registration.

Internal complaints management system

In case of a disagreement between the parties on any issue related to this or other agreements, customers may file complaints with the Claims and Customer Service department by letter to Apartado de Correos 35.250, 28080, Madrid or by email to santander_reclamaciones@gruposantander.es, or with the Customer Ombudsman's Office, Apartado de Correos 14019, 28080, Madrid.

In case of disagreement with the resolution or if, after the expiry of the deadlines established in the applicable regulations, a resolution is not obtained, customers may contact the Bank of Spain's Institution Conduct department, whose powers include the resolution of complaints from banking customers; it is essential to have previously submitted the claim to the Claims and Customer Service department or to the Customer Ombudsman.

 

Governing law and jurisdiction

These Terms and Conditions are governed by common Spanish law.

In the event of a dispute or disagreement exclusively between Banco Santander and the user arising from these Terms and Conditions and for the resolution of any disputes, both parties agree to submit to the jurisdiction of the courts of the city of Madrid, without prejudice to consumer rights on electing the applicable jurisdiction applicable.
